This is a translation. If the English and Dutch versions differ, the Dutch version applies.
1. Who we are and what the words mean
- BusOffer.com: the trade name under which Racks B.V. operates this platform. Racks B.V. is a Dutch company, registered with the Chamber of Commerce (KVK) under number 74865684, with VAT number NL860054962B01, Oosterlaan 24, 2101 ZR Heemstede, the Netherlands. Email: hallo@busoffer.com.
- Platform: the website and the services of BusOffer.com.
- Carrier: the coach company that offers group transport through the platform.
- User or you: anyone who consults the platform, makes a comparison or submits a request.
- Request: a request made through the platform for a price, to register interest or to book a trip with a carrier.
2. When these terms and conditions apply
These terms and conditions apply to the use of the platform. By using the platform, you agree to them. For the trip itself, the terms and conditions of the carrier you choose also apply.
3. What BusOffer.com does
BusOffer.com is an independent comparison site. We put people looking for group transport in touch with carriers that offer it. BusOffer.com is not itself a carrier and does not operate any trips. We are not a party to the contract you conclude with the carrier.
Using the platform is free: you pay BusOffer.com nothing directly.
4. When a contract is concluded
A contract of carriage is concluded only between you and the carrier, and only when the carrier confirms the trip; you will be notified of this by email. BusOffer.com is not a party to that contract and can never confirm a trip on behalf of a carrier.
Until that moment, nothing on this platform commits you to anything: requesting a price comparison, submitting a booking request, asking a carrier a question or registering your interest with a company that has not yet joined are all without obligation.
The same applies to the I want to book this coach button, which appears once a carrier has given you its final price: with it you let that carrier know that you want the trip at that price, but it is a request and not yet a booking. The carrier decides for itself whether to accept the trip.
What applies after its confirmation regarding payment, changes and cancellation is something you agree directly with the carrier, under its own terms and conditions.
5. No right of withdrawal, and why you do not need one
Using the platform is free and without obligation; there is nothing to withdraw from.
For the trip itself you have no statutory right of withdrawal of fourteen days: that does not apply to passenger transport on a fixed date. Whether you can cancel a booked trip and what that costs is set out in the carrier's terms and conditions. Ask about it before you book.
6. Prices and price estimates
The prices on the platform are estimates, calculated from the route and the group size you give and from the carrier's rates. They include VAT and are never binding. The final price, and whether the coach is available, is always confirmed by the carrier itself.
If a carrier has given you its own price, that price replaces our estimate.
BusOffer.com is not liable for any difference between a price estimate shown and the carrier's final price.
7. How we rank the offers
On your price overview, the offers are shown by default in the order Best choice for your group. We calculate that order using four factors:
- how well the coach fits your group (fewer empty seats is better): 30%;
- the price: 30%;
- the average of the reviews from previous customers: 25%, and only for a company with at least three reviews;
- how quickly the company usually replies: 15%, and only if we have measured it.
If a factor does not count, the others weigh proportionally more. Nobody can pay us for a higher position. You can change the order yourself to price, rating or response time.
8. Reviews
A review can only be written by a customer who had a trip with that company through the platform: the company must itself have confirmed the trip as booked, and the date of the trip must have passed. Each customer reviews a trip once, and we check new reviews for signs that they are not genuine. We do not remove a review because it is negative; we do remove it if it breaks the law, is not about a trip that actually took place, or contains someone else's personal data. If a company has no reviews yet, no rating is shown.
9. What we expect from you
- You give correct and complete contact details with a request.
- You do not use the platform for anything that is not allowed, nor to harass carriers.
- You are yourself responsible for what you agree with a carrier following a request.
10. Liability
BusOffer.com does its best to keep the information on the platform up to date and correct, but cannot vouch for the accuracy of what carriers supply themselves (such as prices, availability and facilities). BusOffer.com is not liable for damage caused by the performance, delay or cancellation of a trip between you and a carrier; for a complaint about the trip itself, go to that carrier.
This limitation does not apply to damage caused by our own intent or our own gross negligence, nor to damage that we may not exclude by law.
11. Intellectual property
All rights to the content of the platform, such as texts, design and logos, belong to BusOffer.com or to whoever gave us permission. You may not copy or publish them without our written permission.
12. Complaints and disputes
Do you have a complaint about the platform itself (not about a carrier)? Email hallo@busoffer.com. We reply within one working day.
First address a complaint about the trip itself to the carrier. If you cannot resolve it together:
- with a Belgian coach company: the Consumer Ombudsman Service (Consumentenombudsdienst, consumentenombudsdienst.be) mediates free of charge between consumers and businesses;
- with a Dutch company, or with us: the European Consumer Centre Belgium (ECC Belgium) helps with a dispute with a business from another EU country.
13. Changes
We may change these terms and conditions. The version in force is always on this page, with the date and the version number at the top. A change does not apply to a request you had already submitted.
14. Applicable law and court
These terms and conditions are governed by Dutch law. You always keep the protection that Belgian law gives you as a consumer.
A dispute that we do not resolve together can be brought before the court in Belgium or in the Netherlands. We can only summon you before the Belgian court.
