1. Definitions

- Platform: the website and associated services of BusOffer.com.
- Carrier (vervoerder): the coach company that offers group transport via the platform.
- User: every visitor who consults the platform, makes a comparison or submits a request.
- Request: a request submitted via the platform to show interest in, or to request a booking with, a carrier.
- Business account: an account on the platform for a school, club, company or other organisation, with a separate sign-in for each member.
2. Applicability
These terms and conditions apply to the use of the platform. By using the platform, you agree to these terms and conditions. The actual contract of carriage is also subject to the terms and conditions of the chosen carrier.
3. Nature of the service
BusOffer.com is an independent comparison platform. We act as an intermediary between users looking for group transport and carriers that offer it. BusOffer.com is not itself a carrier and does not operate any trips. We are not a party to the contract concluded between you and the carrier.
4. Formation of a contract
A contract of carriage is concluded exclusively between you and the carrier, and only at the moment the carrier confirms the trip; you will be notified of this by email. BusOffer.com is not a party to that contract and can never confirm a trip on behalf of a carrier.
Until that moment, nothing on this platform commits you to anything: requesting a price comparison, submitting a booking request, asking a carrier a question or registering your interest with a company that has not yet joined are all without obligation.
The same applies to the I want to book this coach button, which appears once a carrier has given you its final price: with it you let that carrier know that you wish to take the trip at that price, but it is a request to the carrier and not yet a booking. The carrier decides for itself whether to accept the trip.
What applies after the carrier's confirmation regarding payment, changes and cancellation is something you agree directly with the carrier, under its own terms and conditions.
5. Prices and price estimates
Prices shown on the platform are estimates, calculated on the basis of the route and group size you have provided. These price estimates are never binding. The final price and availability are always confirmed by the carrier itself. BusOffer.com is not liable for differences between a price estimate shown and the carrier's final price.
6. Obligations of the user
- You provide correct and complete contact details when making a request.
- You do not use the platform for unlawful purposes or to harass carriers.
- You are yourself responsible for the communication and arrangements you make with a carrier following a request.
7. Liability
BusOffer.com endeavours to keep the information on the platform as up to date and accurate as possible, but cannot guarantee the accuracy of data supplied by carriers (such as prices, availability and facilities). BusOffer.com is not liable for damage arising from the performance, delay or cancellation of a contract of carriage between you and a carrier. For complaints about the actual trip, contact the carrier concerned.
8. Intellectual property
All rights to the content of the platform, including texts, design and logos, are vested in BusOffer.com or its licensors. Reproducing or publishing this content without prior written permission is not permitted.
9. Complaints about the platform
Do you have a complaint about the functioning of the platform itself (not about a specific carrier)? Then contact us via the contact page. We aim to respond within one working day.
10. A business account
- Anyone who creates a business account does so on behalf of the organisation and declares that they are authorised to do so. They become the first administrator of the account.
- Each member has their own sign-in and a role. What each role may do is shown in the account under "Colleagues", under "See exactly what each role can do". The organisation's administrators decide who is a member and with which role. A member sees the trips and details of the whole organisation; so remove anyone who no longer belongs from the account.
- A trip that a member requests or books belongs to the organisation. The contract of carriage is concluded between the organisation and the carrier, in the same way as in article 4. The organisation's billing details go to the carrier with every booking, and the carrier invoices the organisation directly.
- If "goedkeuring vooraf" (prior approval) is switched on, a colleague's request only goes to the carrier once a budget holder or administrator of the organisation approves it. The organisation itself decides who gets that role.
- The organisation is responsible for what it puts in the account about other people, such as the names and dates of birth on a passenger list and the name and phone number of the group leader on the day. Only put in what is necessary, and only if you are allowed to. How we handle that data is set out in our privacy policy.
- For the data the organisation puts in the account about other people, we conclude a data processing agreement with it. This can be found in the account under "Details and settings"; an administrator gives consent there on behalf of the organisation.
- A BusOffer.com employee can view the account to help, read-only and with a log that the organisation can see itself. This is set out in article 9 of our privacy policy.
- An administrator of the organisation can close the account. We close an account that has not been used for two years. Thirty days, one week and 48 hours beforehand, the administrators receive an email about this; anyone who then logs in or presses "Account behouden" (Keep account) keeps the account.
11. Changes
BusOffer.com may amend these terms and conditions from time to time. The most recent version can always be found on this page.
12. Applicable law and disputes
These terms and conditions are governed by Dutch law. Disputes that cannot be resolved by mutual agreement will be submitted to the competent court in the Netherlands.
